Refund policy
Strict No Refund, No Return Policy for Art Commissions
This policy specifically applies to all bespoke, custom Art Commission services (Digital Goods) provided by Retro Halo. This stance is necessary to protect the value of the artist's unique time, research, expertise, and intellectual property.
I. Policy for Retro Halo Commission Services
1. The Principle of Non-Recourse
All fees, retainers, and payments made for custom Art Commissions are considered non-refundable and non-recourse. By entering into a commission agreement and remitting payment, the Client agrees that they are purchasing the artist's time, creative labor, and specialized expertise, not a conditional product guarantee.
2. The Non-Refundable Retainer Fee
The initial Retainer Fee (typically 50% of the project quote) is due upfront and is strictly non-refundable under all circumstances. This fee covers immediate costs, including:

Project consultation and brief refinement.

Market and aesthetic research.

Allocation and reservation of the artist's time slot.

Initial concept sketches and preliminary drafting.
This fee is retained even if the Client cancels the project or requests termination after work has commenced, as the artist’s valuable time and resources have already been expended.
3. Payments for Work Completed
If the Client terminates the commission after the Retainer Fee has been used and further milestones or full payments have been remitted:

Retro Halo will not refund any payments already applied toward completed, approved, or in-progress work as defined by the latest Project Statement of Work (SOW).

The Client is obligated to pay for any work completed up to the point of written cancellation.
4. No Refunds After Final Delivery
Once the Client provides final written approval ("Sign-Off") and the final, high-resolution digital files have been delivered, the commission is complete, and no refunds will be issued. Delivery of the licensed digital assets constitutes the transfer of the agreed-upon value, which is non-returnable.
5. Chargeback and Dispute Policy
Any attempt by the Client to seek recovery of funds through a credit card chargeback, payment dispute, or other unauthorized reversal after the work has commenced will be treated as a breach of this agreement. In such an event:

The Client's usage license to the commissioned artwork is immediately and permanently revoked.

The Client must cease all use of the artwork.

Retro Halo will pursue legal action to recover the full cost of the rendered services, plus any associated legal and administrative fees.
6. Single Exception (Retro Halo Inability to Perform)
The only scenario where Retro Halo will issue a refund for funds paid above the initial Retainer Fee is if Retro Halo determines it is technically or aesthetically unable to fulfill the specific, written requirements outlined in the approved Project Brief (SOW). This decision rests solely with Retro Halo. If this determination is made:

The Retainer Fee remains non-refundable.

Any additional funds paid by the Client will be returned.

No intellectual property, concepts, or preliminary work will be transferred to the Client.
